A two part Arts & Entertainment Passion Discovery Program focused on mentoring our youth through hands-on experience in the artistic fields that call out to them. The purpose is to help youth discover their stardom and career talent; whether it's planning events, engineering the next radio hit, producing mind blowing music videos or pursuing their dream as an artist, dancer, musician, poet, comedian, playwright; or even a top fan being rewarded with all the best perks! Like tour passes, concert tickets, and even autographed memorabilia!
Part one of this program is called "CLEARING the CLOUDS": Youth go through hands-on training designed to help them overcome real-life scenarios involving technical issues, lack of proper knowledge and or lack of confidence or discipline. We like to describe these obstacles and challenges as "the CLOUDS."
Part two of this program is called "SEEING the STARS": Here our youth move on to apply all the lessons learned from their experiences. Now ready, our youth participate in community activities, events, workshops and concerts where they plan, create, produce, service and perform; allowing the world to "SEE the STARS" they have become.
TALENT4CHANGE WORKSHOP-SERVICE TERMS AND CONDITIONS The following terms and conditions set forth an agreement between Talent4Change, Inc. (“T4C”) and Client (Sponsor) for services at the suggested location (as listed in the final agreement).
SERVICE PERIOD The Service Period will be the Start Time to End Time as listed above. T4C will arrive approximately fifteen minutes before the service period begins unless otherwise agreed by the parties in writing. If Client would like T4C to arrive earlier Client may be charged for idle time. T4C agrees to be operational for a minimum of 80% during this period; occasionally, operations may need to be interrupted for maintenance of tools and or service equipment. In addition, at least 30 minutes is required after the conclusion of the service period for breakdown and removal.
If the service period exceeds the service period agreed to in the invoice above, the overage will be billed to the Client in whole-hour increments at the Additional Hourly Rate applicable to the Event. Payment for any overage time must be paid before additional hours are provided.
PAYMENT A non-refundable total amount of booking is due upon signing of this Agreement. If payment is received after the date of the Event, Client shall be subject to a late penalty fee of equal to the lesser of 10% of the balance due PER DAY or the highest legal rate allowed by law. T4C accepts checks, Visa, Mastercard, American Express and Discover via PayPal. We do not secure your date on our calendar until full payment is received. Client agrees to pay a $50 penalty fee for any returned checks.
ACCESS, SPACE & POWER FOR TOOLS & EQUIPMENT Client will arrange for an appropriate space for the Workshop/s at the Event's venue. Required space must be level, dry and a 15’x15’ space. Client is responsible for ensuring power is available for the tools & equipment (120V, 15 amps, 3-prong outlet within 100 feet of desired set-up area). All electrical must adhere to contemporary safety standards and supplies (at least 15 amps). The circuit must be free of all other connected loads. Client accepts full responsibility and shall be solely liable for and agrees to indemnify, defend and hold harmless T4C for and against any damages, injuries or delays that occur as a result of failure to comply with these provisions. Client shall provide crowd control, if warranted.
DATE CHANGES & CANCELLATIONS Any request for a date change must be made at least thirty days in advance of the original event date. Change is subject to availability and receipt of a new Service Agreement. If there is no availability for the requested date, the retainer shall be forfeited, but may be used as a credit towards a service within one (1) year of the cancelled event. Any cancellation occurring fewer than ten days prior to the event date shall forfeit all payments received.
DAMAGE TO T4C'S EQUIPMENT Client acknowledges that it shall be responsible for any damage or loss to service provider tools and/or T4C's Equipment caused by: a) Any misuse of the equipment by Client or its guests (invited or uninvited) or b) Any theft or natural disaster. Client acknowledges T4C shall have the right to decline service to Client's guests (invited or uninvited), for misuse, or inappropriate or unruly behavior.
INDEMNIFICATION Client agrees to assume full responsibility and liability for any and all claims arising out of the Event, the use of the tools, equipment or its attendants. T4C will not be held liable for any injury, loss or damage directly or consequently arising out of the use of tools/equipment. Client will indemnify, defend, and hold harmless T4C, its directors, officers, contractors. advisors, agents, and employees (collectively, the (“T4C Indemnitees”) against and from all claims, actions, proceedings, costs, damages, and liability including attorney’s fees (collectively “Claims”), arising out of, in connection with, or resulting from the Booking and/or Client’s Event.
MODEL RELEASE For valuable consideration received, Client hereby grants to T4C and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Event, including its guests, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without Client’s inspection or approval. Client hereby releases T4C and its legal representatives and assigns from all claims and liability relating to said photographs. Client will indemnify, defend, and hold harmless the T4C Indemnities against and from any and Claims arising from or related to the use of pictures taken by T4C at the Event.
MISCELLANEOUS TERMS If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This Agreement contains the entire understanding of the parties in respect of the subject matter hereof and supersede all prior agreements, representations, warranties, covenants and understandings (oral or written) between or among the parties with respect to such subject matter and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration. In the event T4C is unable to supply tools/equipment for at least 80% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received.
